Court Bans Meta From Using News Content to Train AI
Judge blocks data collection without consent and imposes a 1 million BRL daily fine on the owner of Facebook and Instagram.
A São Paulo court has prohibited Meta from using content from news organizations to train its artificial intelligence systems. The preliminary injunction follows a joint request from the National Association of Newspapers, Abert, and Aner.
Judge Guilherme Madeira Dezem suspended portions of the company's new terms of service that were set to take effect on November 20. The ruling blocks the automated collection of articles, photographs, and videos protected by copyright without the prior consent of the authors.
If the company fails to comply, it must pay a daily fine of 1 million BRL. The total penalty is capped at 100 million BRL.
The court order prevents Meta from restricting or blocking the accounts and tools of news outlets that refuse to accept the new conditions. The company has not commented on the decision issued by the 44th Civil Court.
The tech sector faces growing challenges regarding the use of protected data to improve language models. Legal restrictions on training algorithms could increase operational costs for tech firms and limit the development scale of new tools.
