The U.S. Securities and Exchange Commission, known as the SEC, is moving forward with its policies for the digital asset sector. The agency closes the window for public comments on the proposal titled Crypto Asset Regulation this Tuesday.
The text was introduced in August to establish guidelines for investment contracts involving digital currencies. This initiative follows the failure of the U.S. Congress to pass specific legislation creating a comprehensive regulatory framework for the market.
During the 60-day consultation period, the agency gathered approximately 140 contributions from various interest groups and citizens. Suggestions range from exemptions for companies with limited offerings to the creation of a safe harbor to prevent token issuers from being classified as investment contracts.
Entities such as the MiCA Crypto Alliance expressed support for changes to disclosure requirements. The group suggested adjustments so the SEC can better define concepts and data structures specific to the crypto ecosystem.
Other market participants, including SkyBridge Capital founder Anthony Scaramucci, also declared support for the proposed rules. He described the measure as a return to the commission's proper role in light of the organic adoption of these assets by society.
Legal experts point out that SEC rules can be overturned more easily than a law passed by Congress. This environment of regulatory uncertainty may increase the volatility of digital assets and affect the risk appetite of global investors.
