Gonet Seeks Nationwide Halt on Lawsuits Against Betting Ban
The Prosecutor General aims to prevent legal uncertainty while the Supreme Court reviews the constitutionality of the federal ban on gambling.
Prosecutor General Paulo Gonet has requested that the Supreme Court pause all legal proceedings challenging Provisional Measure 1.394/2026. The federal government's decree banned the operation of online betting sites and casinos in Brazil. The request aims to curb the rise of conflicting rulings across regional courts.
This move follows a decision by the Federal Regional Court of the 3rd Region to suspend injunctions that had allowed platforms like Betsul and Casa de Apostas to resume operations. The judge responsible for the ruling highlighted the risk of harm to public order and the need for uniform application of the law. The Office of the Attorney General worked to overturn previously granted authorizations.
Gonet argues that the existence of multiple simultaneous lawsuits creates a scenario of regulatory instability. The goal is to await a definitive ruling on the validity of the measure from the Supreme Court. The case rapporteur, Justice Luiz Fux, has already held public hearings to debate the matter with various sectors of society.
Legal uncertainty regarding the betting sector in Brazil could increase volatility for companies exposed to the technology and entertainment segments. The outcome of this dispute in the Supreme Court will determine the regulatory future and the fiscal impact of gambling operations on the national financial market.
